Terms of Use

These terms explain how you may use eKad. By creating an account or using our services, you agree to them.

1. Who we are

eKad is operated by eKad. In these terms, "we" means eKad, the "Platform" means the eKad website, cards and services, a "Host" is a user who creates a card or event, and a "Guest" is anyone who opens a card.

2. Your account

  • You must be 18 or older to create an account.
  • The information you give us must be true and up to date.
  • You are responsible for keeping your password safe and for all activity in your account.

3. Acceptable use

You may use the Platform to create, share and manage invitations for your lawful events. You must not:

  • upload content that is unlawful, defamatory, obscene, hateful or that infringes anyone's rights;
  • send spam or impersonate any person or organisation;
  • copy, scrape, bulk-download, resell or imitate the Platform's templates, designs, illustrations, animations or code;
  • try to bypass the Platform's protections, limits or security, or disrupt its operation.

4. Your content

Photos, text, music and information you upload ("Your Content") remain yours. You give us a non-exclusive, royalty-free licence to store, process and display Your Content only as needed to provide the Platform to you and your guests.

You confirm that you have the right to use Your Content, including permission from people in your photos and a licence for any music you upload.

5. Guest data

If you enter guests' names or phone numbers, you are responsible for making sure you may use that information to invite them. We process personal data in line with the Personal Data Protection Act 2010 and our Privacy Notice. Guests can ask for their information to be deleted through the Host or by contacting us.

6. Salam kaut and guests' money

Salam kaut is paid by Guests directly into the Host's own bank account, DuitNow or e-wallet. We do not receive, hold or transfer that money and are not a party to those transactions. For Event Ops, ticket and booth payments settle into the organiser's own payment gateway account.

7. Plans, payments and refunds

  • Prices are shown in Malaysian Ringgit (RM) before you pay.
  • Features and how long your card stays live depend on the plan you choose.
  • Refunds follow the policy shown at purchase and your rights under the Consumer Protection Act 1999.

8. Link validity and Kad Kenangan

Card links stay live for the period of your plan. Before and after a link expires you can download your Kad Kenangan for personal keeping. We may delete card data after the retention period stated in your plan.

9. Our copyright and intellectual property

The Platform, the eKad name and logo, templates, card designs, illustrations, animations, guide text and source code belong to eKad and are protected by the Copyright Act 1987 and international law. We give you a limited, non-exclusive, non-transferable licence to use the templates for your own event through the Platform. Kad Kenangan files are for personal keeping only and may not be sold or distributed as templates. See our Copyright Notice for details.

10. Suspension and termination

We may hide a card or suspend an account that breaks these terms or the law, and will tell you the main reason where we are allowed to. You may stop using the Platform at any time.

11. Service and liability

We work to keep the Platform available, but it is provided "as is" and may be interrupted for maintenance or for reasons outside our control. To the extent the law allows, we are not liable for indirect losses, and our total liability is limited to what you paid us in the previous 12 months. Nothing in these terms limits rights you have under Malaysian law that cannot be excluded.

12. Changes to these terms

We may update these terms. We will tell you about important changes by email or on the Platform before they take effect.

13. Governing law

These terms are governed by the laws of Malaysia, and any dispute is subject to the jurisdiction of the Malaysian courts.
